Form 05 — Notice of Appeal to a Court of Appeals from a Judgment or Order of a District Court or a Bankruptcy Appellate Panel is a document used by a party appealing a court decision or order issued by a District Court or a Bankruptcy Appellate Panel. This form is used to notify the court of an appeal from a lower court’s or appellate panel’s decision. It is typically filed with the appeals court and includes information regarding the appellant, the lower court’s decision, the type of appeal, and any additional documents or evidence supporting the appeal. There are two types of Form 05 — Notice of Appeal to a Court of Appeals from a Judgment or Order of a District Court or a Bankruptcy Appellate Panel: civil appeals and criminal appeals. The civil appeals version is used in civil cases to appeal a district court’s decision or order. The criminal appeals version is used in criminal cases to appeal a district court’s decision or order. Both versions of Form 05 must be completed and filed with the court of appeals where the appeal is being filed.
