2.74.6 RACKETEER INFLUENCED AND CORRUPT ORGANIZATIONS ACT-"SECTION A" (Third Element-Unanimity of Racketeering Acts) is a federal law that provides for criminal penalties for persons who participate in a criminal enterprise with the intent to commit a pattern of racketeering activities. This law requires that each member of the criminal enterprise agree to commit at least two racketeering acts within a 10-year period. These acts must be related to each other and must have the same goal of promoting or facilitating the criminal enterprise. There are two types of unanimity of racketeering acts: 1) unanimity of purpose, which requires that all members of the criminal enterprise have the same purpose in mind; and 2) unanimity of action, which requires that all members of the criminal enterprise commit the same racketeering acts. Both types of unanimity of racketeering acts are necessary for a violation of the 2.74.6 RICO Act.
