3.8.6 Heinous, Cruel, or Depraved Manner of Committing the Offense is defined as an act that is exceptionally heinous, cruel, or depraved. Examples of this type of offense include murder, rape, kidnapping, robbery, or arson that is committed in a manner that is especially heinous, cruel, or depraved. Specific types of heinous, cruel, or depraved manner of committing the offense include torture, infliction of extreme physical or mental pain, heinous physical abuse, psychological abuse, sexual abuse, extreme physical or mental suffering, or prolonged and repeated abuse of a victim over time. In addition, the offender must have had a heightened level of depravity, such as an intent to torture, degrade, humiliate, or terrorize a victim, or to cause them severe emotional distress.
