Sec. 1028(A)(1) addresses fraudulent production of an identification document, authentication feature, or false identification document. It is a federal offense to knowingly produce, transfer, possess, or use an identification document, authentication feature, or false identification document knowing it was produced without lawful authority. This includes producing an identification document with false information, creating an identification document with the intent to defraud, and using a false identification document for any purpose. Types of fraudulent identification documents can include counterfeit driver’s licenses, Social Security cards, and state or federal identification cards. Authentication features can include biometric data, digital signatures, and encryption. False identification documents can include altered documents, documents with fictitious information, and documents with missing information.
