18 U.S.C. Sec. 1030(E)(11) Definition of “Loss” is the legal definition of the term “loss” as defined in the Computer Fraud and Abuse Act (CAA). This definition states that “loss” means any reasonable cost to any victim, including the cost of responding to an offense, conducting a damage assessment, and restoring the data, program, system, or information to its condition prior to the offense, and any revenue lost, cost incurred, or other consequential damages incurred because of interruption of service. This definition is broken down into three categories: reasonable costs, revenue lost, and consequential damages. Reasonable costs are those associated with responding to the offense, conducting a damage assessment, and restoring the data, program, system, or information to its condition prior to the offense. Revenue lost is the actual monetary cost incurred due to the interruption of service. Consequential damages are any additional economic losses resulting from the interruption of service.
