18 U.S.C. Sec. 2314 prohibits the transportation, receipt, and possession of goods, securities, moneys, or other items of value which have been stolen, converted, or taken by fraud. This law applies to all forms of transportation, including interstate and foreign shipment, and it applies to all stolen or fraudulently obtained goods regardless of their value. The law is broken down into two distinct sections. The first section of the law prohibits the transportation of stolen goods in interstate commerce or the possession of stolen goods which have been transported in interstate commerce. It also prohibits the receipt of goods which have been transported in interstate commerce if the recipient knows or has reasonable cause to believe that the goods have been stolen. The second section of the law prohibits the transportation, receipt, or possession of goods, securities, moneys, or other items of value which have been converted or taken by fraud. This applies regardless of whether the goods were taken from interstate or foreign commerce. It also applies to goods which are of any value, including those of a very small value. 18 U.S.C. Sec. 2314 is a federal criminal statute which carries both civil and criminal penalties. The civil penalty could include the payment of a fine, restitution, or other civil remedies.
