8 U.S.C. Sec. 1325(A)(3) Entry By False or Misleading Representation — Elements is a federal statute that states that any individual who enters the United States by means of a false or misleading representation or by any other fraud or willful misrepresentation of a material fact is guilty of a misdemeanor. This statute covers two types of entry by false or misleading representation: false claim to citizen status and false/misleading representation of material facts. In the case of false claim to citizen status, the individual must have falsely and willfully represented himself or herself as a United States citizen for the purpose of obtaining any benefit or privilege not authorized by law. In the case of false/misleading representation of material facts, the individual must have knowingly and willfully represented, concealed, or withheld any material fact in order to obtain any benefit or privilege not authorized by law. Both offenses are punishable by a fine, imprisonment for not more than six months, or both.
