8.44 Escape from Custody (18 U.S.C. Sec. 751(a)) is a federal crime that prohibits a person from escaping from the custody of any officer, employee, or person employed by the United States or any state or local law enforcement agency. It applies when the person has been arrested for, charged with, or convicted of any offense. There are three types of 8.44 Escape from Custody: voluntary, involuntary, and attempted escape from custody. Voluntary escape from custody is when a person willfully and voluntarily escapes from the custody of any officer, employee, or person employed by the United States or any state or local law enforcement agency. Involuntary escape from custody is when a person escapes from the custody of any officer, employee, or person employed by the United States or any state or local law enforcement agency without his or her consent. Attempted escape from custody is when a person attempts to escape from the custody of any officer, employee, or person employed by the United States or any state or local law enforcement agency.
