8.8 Simple Assault of Person Under Age 16 (18 U.S.C. Sec. 113(a)(5)) refers to the illegal act of intentionally causing physical injury to a person under the age of 16. This type of assault is classified as a federal offense and is punishable by up to one year in prison or a fine of not more than $1,000, or both. There are three primary types of 8.8 Simple Assault of Person Under Age 16 (18 U.S.C. Sec. 113(a)(5)): 1) Assault by physical contact — This type of assault involves the physical contact of a person under the age of 16 with the intent to cause physical injury. 2) Assault by threat — This type of assault occurs when an individual threatens to cause physical injury to a person under the age of 16. 3) Assault with a deadly weapon — This type of assault involves the use of a deadly weapon, such as a firearm or knife, to cause physical injury to a person under the age of 16. In addition to the potential for prison time and/or fines, individuals convicted of 8.8 Simple Assault of Person Under Age 16 (18 U.S.C. Sec. 113(a)(5)) may also be subject to other penalties, such as probation, mandatory counseling, and/or community service.
