9.30 Controlled Substance-Continuing Criminal Enterprise (21 U.S.C. Sec. 848) is a federal law that makes it a crime for individuals to be involved in a continuing criminal enterprise (CCE) involving the distribution of controlled substances. This law defines CCE as engaging in a "continuing series of violations" of the Controlled Substances Act (CSA) that "are undertaken by the defendant in concert with five or more other persons with respect to whom the defendant occupies a position of organizer, a supervisory position, or any other position of management." There are three types of 9.30 Controlled Substance-Continuing Criminal Enterprises (21 U.S.C. Sec. 848): 1. Organizational Cues: These involve the leadership of a large-scale drug trafficking organization with five or more individuals working together in a hierarchical structure to commit drug offenses. 2. Supervisory Cues: These involve the leadership of a drug trafficking organization with fewer than five individuals working together in a hierarchical structure to commit drug offenses. 3. Managerial Cues: These involve individuals who do not occupy a leadership role, but who manage or otherwise facilitate the drug trafficking activities of a drug organization.
