9.34 Firearms-Possession of Unregistered Firearm is a criminal offense involving the possession of a firearm without the proper registration or permit on file with the appropriate government authority. The offense can be charged as either a misdemeanor or felony depending on the specific circumstances. There are three main types of this offense: possession of an illegal firearm, possession of an unregistered firearm, and possession of an unlicensed firearm. Possession of an illegal firearm is when a person owns or possesses a firearm that is prohibited by law (i.e., those that are fully automatic or have a silencer). Possession of an unregistered firearm is when a person possesses a firearm that has not been properly registered with the appropriate government authority. Finally, possession of an unlicensed firearm is when a person possesses a firearm that he or she does not have a valid permit to own or possess. All of these offenses carry potential jail time and fines.
