Utah Reckless as to Circumstances of Conduct or as to Result is a criminal offense that occurs when an individual acts recklessly and either endangers another person or causes damage to property. Reckless as to Circumstances of Conduct or as to Result means that the individual knew or should have known that their actions would create a substantial risk of harm or damage. There are two types of Utah Reckless as to Circumstances of Conduct or as to Result: reckless as to circumstances of conduct and reckless as to the result. Reckless as to circumstances of conduct occurs when an individual acts without due care or caution and creates a substantial risk of harm or damage. The individual must have known or should have known that their actions would create a substantial risk of harm or damage. Reckless as to the result occurs when an individual acts with the intent of causing harm or damage to another person or property and their actions create a substantial risk of harm or damage. Under Utah law, Reckless as to Circumstances of Conduct or as to Result is a Class B misdemeanor. Penalties for Reckless as to Circumstances of Conduct or as to Result include a jail sentence of up to 6 months and/or a fine of up to $1,000.
