The Utah Section 1983 Claim--Elements are the necessary elements that must be established by a person wishing to bring a civil action under the Utah Civil Rights Act (UCLA) or Section 1983 of the Federal Civil Rights Act. The claim must include the following elements: 1. That the defendant was acting "under color of state law." 2.
