Utah Negligent Infliction of Emotional Distress-Direct Victim is a type of tort claim which is based on the negligent conduct of a defendant that causes severe emotional distress to a plaintiff. In Utah, this tort claim is also known as Negligent Infliction of Mental Suffering. This claim is based on the idea that a defendant's negligence has caused a plaintiff to suffer emotional distress as a direct result of the defendant's actions. This tort claim is also divided into two types: 1. Negligent infliction of emotional distress-Direct victim: This type of claim is based on the concept of direct victimization, which means that the defendant's negligence directly causes the plaintiff to suffer emotional distress. 2. Negligent infliction of emotional distress-Bystander: This type of claim is based on the concept of bystander liability, which means that the defendant's negligence causes a bystander to suffer emotional distress.
