The Utah Application for Authority to Transact Business for a Tribal Limited Liability Company is a form used to obtain authority for a tribal limited liability company to transact business in the state of Utah. This form must be filed with the Utah Department of Commerce to register a Tribal LLC. The application must be accompanied by a filing fee and other required documents. There are two types of Utah Application for Authority to Transact Business for a Tribal Limited Liability Company: the Standard and the Long Form. The Standard Form is for Tribal LCS that are organized under the laws of a federally-recognized tribe. This form requires the name and address of the LLC, the name and address of the organizer, the name and address of the registered agent, and the name and address of the tribe. The Long Form is for Tribal LCS that are not organized under the laws of a federally-recognized tribe. This form requires the same information as the Standard Form, plus additional information such as the names and addresses of all the members of the LLC. In addition, the Long Form requires a certificate of good standing from the tribe, a copy of the LLC’s articles of organization, and a copy of the LLC’s operating agreement. Once the Utah Application for Authority to Transact Business for a Tribal Limited Liability Company has been approved, the Tribal LLC is legally recognized as an entity in the state of Utah and is authorized to conduct business in the state.
