The Utah Guidelines for Appeal Procedures The United States Bankruptcy Appellate Panel of the Tenth Circuit are established by the U.S. Bankruptcy Code and the Bankruptcy Rules to provide a uniform procedure for the filing and resolution of appeals before the Bankruptcy Appellate Panel (BAP). The guidelines set forth the standards and procedures for filing appeals, including the following: (1) Notice of Appeal: The notice of appeal must be filed within fourteen (14) days of the entry of the order or judgment from which the appeal is taken. (2) Appellant’s Brief: The appellant must file a brief within forty-five (45) days of the entry of the order or judgment from which the appeal is taken. (3) Appealed’s Brief: Thappealedee must file a brief within thirty (30) days of the filing of the appellant’s brief. (4) Oral Argument: Oral argument is not required, however, the parties may request oral argument within twenty-one (21) days of the filing of the appealed’s brief. (5) Decision: The BAP will issue a decision within ninety (90) days of the filing of the appellant’s brief, or within thirty (30) days of the oral argument, if requested. (6) Stay: A stay of any order or judgment is not automatically granted upon the filing of the notice of appeal, but may be requested. (7) Fees: The filing fee is $250.00. Additional fees may be required for an appeal that requires preparation of a record on appeal, or if a party requests an oral argument.
