A Utah Modified Protective Order (also called a restraining order) is a court-issued order that is designed to protect a person from harm or harassment from another person. It is issued by a judge after a hearing in which both parties have the opportunity to present evidence. A Utah Modified Protective Order can be issued in either a criminal or civil case. There are two types of Utah Modified Protective Orders: injunction for protection against domestic abuse and a protective order for stalking. An injunction for protection against domestic abuse is issued when the court finds that one person has committed an act of domestic abuse against another person. The order prohibits the perpetrator from harassing, threatening, or otherwise contacting the victim. It may also require the perpetrator to stay away from the victim's home and workplace. A protective order for stalking is issued when the court finds that one person has stalked another. The order prohibits the perpetrator from harassing, threatening, or otherwise contacting the victim. It may also require the perpetrator to stay away from the victim's home and workplace. Both types of Utah Modified Protective Orders are valid for a period of time determined by the court. Violating the order may result in serious legal consequences.
