The Vermont Petition to Enforce a Restitution Judgment is a document used to collect a court-ordered restitution from a debtor who has failed to pay. It is a legal remedy for victims of crime to collect the restitution money the court has ordered the debtor to pay. The Petition allows the victim to seek enforcement of the court order in the form of a judgment lien on the debtor’s real or personal property, wage garnishment, or other means of enforcement. There are two types of Vermont Petition to Enforce a Restitution Judgment: 1) Petition to Enforce a Restitution Judgment for a General Civil Case and 2) Petition to Enforce a Restitution Judgment for a Criminal Case. The Petition for a General Civil Case is used when the court orders a restitution payment as part of a civil judgment, such as a civil lawsuit for damages or breach of contract. The Petition for a Criminal Case is used when the court orders a restitution payment as part of a criminal sentence, such as for a criminal conviction or plea agreement.
