The Vermont Waiver of Extradition Process is a process in which a person (the fugitive) who is wanted in Vermont for a criminal offense, waives his or her right to contest an extradition request. The process is initiated when the Governor of Vermont signs a Governor's Warrant, which orders the fugitive to be arrested and returned to the state. The fugitive then has the option of requesting a Waiver of Extradition Hearing, which allows them to voluntarily return to Vermont to face the charges against them. If the fugitive waives the hearing, they must surrender to Vermont law enforcement officers and will then be transported to Vermont for prosecution. There are two types of Vermont Waiver of Extradition Process: Regular Waiver of Extradition and Governor's Warrant Waiver of Extradition. In a Regular Waiver of Extradition, the fugitive must sign a waiver of extradition and agree to voluntarily return to Vermont for prosecution. In a Governor's Warrant Waiver of Extradition, the fugitive must surrender to Vermont law enforcement officers and will then be transported to Vermont for prosecution.
