Vermont Leave of Absence for COVID-19, also known as the Vermont COVID-19 Leave, provides employees with job-protected time off if they are unable to work due to COVID-19 related reasons. This leave aims to support employees who need to take time off to care for themselves or their family members during the ongoing pandemic. In Vermont, there are two main types of leave for COVID-19 related situations: the Vermont Emergency Paid Sick Leave and the Vermont Family and Medical Leave (FMLA) for COVID-19. 1. Vermont Emergency Paid Sick Leave: The Vermont Emergency Paid Sick Leave is a short-term leave option for employees who are unable to work due to reasons related to COVID-19. Under this provision, eligible employees can take up to 10 workdays (or a maximum of 80 hours) of paid leave for the following situations: a. They are subject to a quarantine or isolation order issued by the state or a healthcare provider. b. They have been advised by a healthcare provider to self-quarantine due to COVID-19 concerns. c. Furthermore, they are experiencing COVID-19 symptoms and seek a medical diagnosis. d. Furthermore, they need to care for a family member who is subject to a quarantine or isolation order or has been advised to self-quarantine by a healthcare provider. e. Furthermore, they need to care for a child whose school or childcare provider has been closed or is unavailable due to the pandemic. During this leave, eligible employees receive their regular pay rate, up to a maximum of $511 per day or $5,110 in total for their own COVID-19 related situations, or a maximum of $200 per day or $2,000 in total to care for a family member or child. 2. Vermont Family and Medical Leave (FMLA) for COVID-19: The Vermont Family and Medical Leave Act (FMLA) provides eligible employees with job-protected leave to care for their own serious health condition or that of a family member. However, due to the COVID-19 pandemic, Vermont enacted an amendment to the FMLA, allowing employees to take leave for COVID-19 related reasons. This includes: a. An employee needing to care for themselves if diagnosed with COVID-19. b. An employee needing to care for a family member who is diagnosed with COVID-19. c. An employee needing to care for a child due to school or childcare provider closure related to COVID-19. This amendment expands the scope of the FMLA to include COVID-19 situations, providing employees with up to 12 weeks of job-protected leave in a 12-month period. This leave may be unpaid or paid if the employee has accrued paid leave available. Overall, the Vermont Leave of Absence for COVID-19 encompasses both the Emergency Paid Sick Leave and the FMLA amendments. These provisions aim to support employees facing COVID-19 related challenges by providing them with necessary time off while protecting their job security.
