Washington Lack of Probate" Affidavit- Joint Tenancy is an affidavit form created by the Washington State Department of Revenue that is used to transfer the title of real property from a deceased person to their surviving joint tenant(s). The affidavit allows the surviving joint tenant(s) to avoid probate by affirming that the deceased person had an interest in the property as a joint tenant and that the deceased has died. The affidavit also requires the surviving joint tenant(s) to provide information such as the deceased's name, date of death, information about the property, and the name of the surviving joint tenant(s). There are two types of Washington Lack of Probate" Affidavit- Joint Tenancy: (1) Affidavit for Real Property; and (2) Affidavit for Personal Property.
