A Washington Notice of Civil Appeal is a document filed with the Court of Appeals in the state of Washington when an individual or organization wishes to appeal a lower court decision. It is the first step in appealing a civil case in Washington state. There are three types of Washington Notice of Civil Appeal: Direct Appeal, Interlocutory Appeal, and Discretionary Review. A Direct Appeal is used when a person or organization wishes to appeal a final judgment or order from a trial court. It requires that the appellant provide the court with a copy of the lower court’s opinion or order, as well as other documents such as a transcript of the proceedings. An Interlocutory Appeal is used when a person or organization wishes to appeal an order from a trial court that is not a final judgment or order. This includes orders denying a motion for summary judgment, ruling on a motion to dismiss, or granting a motion for a new trial. A Discretionary Review is used when a person or organization wishes to appeal an interlocutory order to the Supreme Court of Washington. This type of appeal is only available in certain circumstances and is decided by the Supreme Court on a case-by-case basis. The appellant must provide the court with a copy of the lower court’s opinion or order, as well as other documents such as a transcript of the proceedings.
