Washington DREAM Court Referral for Program Eligibility (also known as Request for a defendant to be considered for the new DREAM program) is a process established by the Washington State legislature in 2020. This process allows individuals charged with certain nonviolent offenses to be considered for the Washington State DREAM program. The DREAM program is designed to provide restorative justice and rehabilitation services to individuals who may benefit from such services rather than incarceration. There are two types of court referrals for program eligibility: voluntary and involuntary. A voluntary referral is initiated by the defendant or the defendant’s attorney, who must submit an application to the court. An involuntary referral is initiated by the prosecutor, who must submit a motion to the court. In either case, the court will review the application or motion and make a determination whether the defendant is eligible for the DREAM program. If the court finds that the defendant is eligible, the defendant can then be referred to the DREAM program for further evaluation and services.
