The Washington Declaration of Proposed Guardian (Non-Certified) is a legal document used in the state of Washington for a person who is seeking to be appointed as a guardian over an incapacitated adult. This document is used to inform the court that the person filing the document is willing and available to act as guardian for the incapacitated adult. A Washington Declaration of Proposed Guardian (Non-Certified) must include information about the proposed guardian, the incapacitated adult, and a list of the powers and authority the proposed guardian is requesting. There are two types of Washington Declaration of Proposed Guardian (Non-Certified): 1) Full Guardianship and 2) Limited Guardianship. A Full Guardianship grants the proposed guardian full authority over the incapacitated adult, including the power to make decisions about healthcare, finances, and residence. A Limited Guardianship grants the proposed guardian limited authority over the incapacitated adult, such as the power to make decisions about healthcare or finances, but not residence. Both types of Washington Declaration of Proposed Guardian (Non-Certified) require the proposed guardian to appear in court to be evaluated by a judge before being appointed.
