The Washington Petition for Deferred Prosecution (effective August 2, 2016) is a type of pre-trial diversion program that allows certain individuals facing criminal charges to be diverted away from prosecution and into a program of supervision and treatment. The program is managed by the Washington State Department of Corrections and is available for eligible individuals who have been charged with certain non-violent offenses. The Petition for Deferred Prosecution allows the individual to enter into a contract with the Prosecutor’s Office that is supervised by the Department of Corrections. If the individual successfully completes the program, the charges will then be dismissed. There are two types of Washington Petition for Deferred Prosecution (effective August 2, 2016): Standard and Special. The Standard Petition for Deferred Prosecution is available to individuals who are charged with certain non-violent offenses and have no prior criminal history. The Special Petition for Deferred Prosecution is available to individuals who are charged with certain non-violent offenses and have a prior criminal history.
