A Washington Final Non-Parent Custody Order is a court order that grants legal custody of a child to an adult who is not the child's parent. This type of order is issued in cases where a child's biological parents are unable or unwilling to care for the child. The order grants the non-parent legal custody of the child for an indefinite period of time. In Washington State, there are two types of Final Non-Parent Custody Orders: Temporary and Permanent. A Temporary Final Non-Parent Custody Order may be issued when a child needs immediate care and protection, but the court is not ready to make a permanent custody decision. A Permanent Final Non-Parent Custody Order may be issued when the court has determined that the non-parent is a suitable custodian for the child and that the child's best interests would be served by granting the non-parent legal custody. The court must consider the non-parent's fitness as a custodian, the child's wishes, and any other relevant factors before granting a Permanent Final Non-Parent Custody Order.
