Washington Motion for Order Transferring Jurisdiction to Tribal Court (MTA FTC) is a motion filed by an Indian tribe in a Washington state court to transfer the jurisdiction of a case to its own tribal court. This motion is generally used when the tribal court has jurisdiction over a matter, but state court proceedings have already been initiated. The Indian tribe requests that the state court transfer the case to the tribal court in order to avoid the cost and complexity of two simultaneous proceedings. The motion must be filed within the time period prescribed by the applicable law, and must be supported by sufficient evidence that the tribal court has jurisdiction over the case. There are two types of Washington Motion for Order Transferring Jurisdiction to Tribal Court (MTA FTC): the Standard Motion and the Expedited Motion. The Standard Motion is the most common type and requires a showing of good cause for the transfer. The Expedited Motion is utilized in emergency situations and does not require a showing of good cause.
