Washington Sexual Assault Protection Order (WAS APO) is a civil court order issued by a judge that requires an individual who has committed or is likely to commit an act of sexual assault to stay away from the protected individual. WAS APO can include provisions to prevent contact or communication, or to limit the behavior of the individual. There are two types of WAS APO: Temporary Sexual Assault Protection Order (T-WASAPO) and Extended Sexual Assault Protection Order (E-WASAPO). T-WASAPO is issued without notice to the responding party and is valid for a period of up to 14 days. The court may extend the order for an additional 14 days if the protected person requests an extension. E-WASAPO is issued after notice is given to the responding party and is valid for up to one year. The court may extend the order for an additional year, upon request of the protected person, if the court finds that there is a continuing threat of sexual assault. Both types of WAS APO allow the court to order the individual to stay away from the protected person, their residence, and their workplace. The court may also order the individual to turn in any firearms or other weapons they possess, complete a Batterer Intervention Program or other services, and pay restitution to the protected person.
