The Washington Variance Application- Student Learner Exemption Minor Work is a program designed to provide relief to employers who hire students under the age of 18. This program allows employers to apply for an exemption from the Washington State Labor and Industries Employment Standards Act, which requires employers to pay minors a minimum wage and overtime rate. The Student Learner Exemption program permits employers to pay students under 18 years of age a reduced hourly rate, as long as the student is enrolled in a recognized educational program and is learning a trade, craft, or occupation. The program also allows employers to employ minors in certain types of work that would otherwise be prohibited. Types of Washington Variance Application- Student Learner Exemption Minor Work include: • Apprentice/Trainee: Employers may pay a reduced wage to minors ages 14 to 18 who are learning a trade, craft, or occupation. • Student-Learner: Employers may pay a reduced wage to students under 18 years of age who are enrolled in a recognized educational program. • Internship: Employers may pay a reduced wage to minors who are gaining professional work experience through an internship or similar program. • Seasonal/Temporary: Employers may pay a reduced wage to minors who are employed in seasonal or temporary positions. • Agricultural: Employers may pay a reduced wage to minors who are employed in agriculture-related jobs.
