The Wisconsin Petition for Termination of Joint Tenancy or Life Estate (867.04) is a legal document used when two or more individuals (called co-tenants) jointly own a property and seek to dissolve their ownership rights. This petition allows one of the co-tenants to request that the court terminate the joint tenancy or life estate and transfer the property to the individual petitioner. There are two types of Wisconsin Petition for Termination of Joint Tenancy or Life Estate (867.04): 1) Termination of Joint Tenancy and 2) Termination of Life Estate. The termination of joint tenancy requires all co-tenants to agree to the termination and transfer of the property to the petitioner; whereas the termination of life estate requires the consent of the life tenant and the petitioner's heirs. The petition must include information on the petitioners, the co-tenants, the property, and the legal reason for the termination of the joint tenancy or life estate.
