Wisconsin Order for Ancillary Administration is a judicial order which allows an out-of-state personal representative to administer an ancillary estate in Wisconsin. An ancillary estate is an estate located outside the state where the decedent was domiciled at the time of death. This order permits the personal representative to perform duties such as collecting the decedent’s assets, disbursing the same, and filing tax returns. The order also permits the personal representative to receive assets from Wisconsin and to make distributions to Wisconsin creditors. There are two types of Wisconsin Order for Ancillary Administration: (1) Full Ancillary Administration and (2) Limited Ancillary Administration. A Full Ancillary Administration provides the broadest range of powers and authority to the personal representative. It is appropriate when the Wisconsin assets are substantial in relation to the total estate. A Limited Ancillary Administration is usually sought when the Wisconsin assets are minimal in relation to the total estate. This type of order is tailored to the specific needs of the estate.
