The Wisconsin Petition for Termination of Parental Rights — Indian Child Welfare Act (WPTPR-ICWA) is a complex set of laws designed to protect the best interests of Native American tribes and their children. This law gives tribes the authority to intervene in matters related to the termination of parental rights of Native American children, and to ensure that Native American children are placed into culturally appropriate homes. The WPTPR-ICWA consists of three main types of petitions: (1) Termination of Parental Rights (TPR); (2) Placement of Indian Children (PIC); and (3) Voluntary Placement Agreement (VIA). The TPR petition is used to terminate the parental rights of the child’s biological parents and legally transfer guardianship to a third party. The PIC petition is used to place the child in a foster home or other suitable placement that is in the best interests of the child. The VIA petition is used when the parents voluntarily place the child in the care of a third party. All three petitions must comply with the IOWA and its standards.
