The Wisconsin Order on Motion for Transfer to Tribal Court — Indian Child Welfare Act is a legal document issued by a Wisconsin court in order to transfer a case involving an Indian child from the Wisconsin court system to a tribal court. This order is used when the Indian Child Welfare Act (IOWA) applies to the case and when a party has requested that the case be transferred to the tribal court. The Wisconsin Order on Motion for Transfer to Tribal Court — Indian Child Welfare Act is issued when the court determines that the transfer is in the best interests of the child. There are two types of Wisconsin Order on Motion for Transfer to Tribal Court — Indian Child Welfare Act: (1) Transfer to Tribal Court for Exclusive Jurisdiction and (2) Transfer to Tribal Court for Concurrent Jurisdiction. Transfer to Tribal Court for Exclusive Jurisdiction is when all the proceedings related to the case are to be handled by the tribal court. Transfer to Tribal Court for Concurrent Jurisdiction is when both the state court and the tribal court can handle the proceedings related to the case.
