A Wisconsin Petition in Juvenile Court for Temporary Restraining Order and/or Petition and Motion for Injunction Hearing (Child Abuse) is a legal document used to request a court order to protect a child from abuse or neglect. The petition may be filed by a parent, guardian, or other adult in the child’s life. The petition requests the court to issue a restraining order that would prohibit the abuser from contact with the child and/or order an injunction hearing to determine if a long-term protection order should be issued. There are two types of Wisconsin Petition in Juvenile Court for Temporary Restraining Order and/or Petition and Motion for Injunction Hearing (Child Abuse): a Temporary Restraining Order (TO) and a Petition and Motion for Injunction Hearing (PMI). A TO is a court order that prohibits the abuser from having contact with the child for a certain period of time. The TO can be requested without a hearing and is typically issued for a period of up to 30 days. A PMI His a court order that requires a hearing to determine whether a long-term protection order should be issued. At the hearing, the court will consider evidence and testimony to determine if the child is at risk of abuse or if the abuser should be prohibited from contact with the child. If the court finds that the child is at risk, a long-term protection order may be issued.
