A Wisconsin Deferred Prosecution Agreement (DPA) is an agreement between a criminal defendant and the State of Wisconsin that allows the accused to avoid criminal prosecution by admitting to the charges. The accused agrees to certain conditions, such as completing a rehabilitation program, and if they follow the conditions, the charges will be dismissed. There are two types of Wisconsin Deferred Prosecution Agreements: standard DPA's and juvenile DPA's. Standard DPA's are available to any adult who has been charged with a felony or misdemeanor and is willing to admit guilt and comply with the conditions. Juvenile DPA's are available to anyone under the age of 17 who has been charged with a juvenile offense and is willing to admit guilt and comply with the conditions. Both types of DPA's allow the accused to avoid criminal prosecution, maintain their innocence, and potentially have their charges dismissed.
