The Wisconsin Order for Recoupment of Costs of Legal Services, also known as the W.O.R.C.L.S., is a court order that allows a party to recover the costs of legal services from the other party. Generally, the party who was successful in the case or action is able to recoup costs from the other party. This includes costs for litigation services, such as filing fees, attorneys’ fees, and other legal costs. The W.O.R.C.L.S. is available for two types of cases: civil and criminal. In both cases, the court will consider the parties’ financial ability to pay, the reasonableness of the costs, and the parties’ respective contributions to the cost of the legal services. In civil cases, the court may require the unsuccessful party to reimburse the successful party for their reasonable lawyer fees and court costs. In criminal cases, the court may require the defendant to reimburse the state for its legal costs. In order to receive a W.O.R.C.L.S., the party seeking recoupment must first file a motion for recoupment with the court. The motion must be accompanied by a detailed listing of all legal costs, including the cost of filing fees, attorneys’ fees, and any other legal costs. The motion must also include an affidavit signed by the party seeking recoupment, attesting to the accuracy of the costs listed. The court will then review the motion and make a decision whether the recoupment should be granted. If the court decides that the recoupment should be granted, a Wisconsin Order for Recoupment of Costs of Legal Services will be issued. The W.O.R.C.L.S. will specify the amount of the costs to be recouped, as well as the payment terms. The court may also impose sanctions or other restrictions on the unsuccessful party if they fail to comply with the terms of the order.
