The Wisconsin Petition for Temporary Restraining Order and/or Petition and Motion for Injunction Hearing (Harassment) is a legal document used to obtain a court order that prohibits an individual from engaging in certain behaviors, such as harassment, intimidation, or threats. The petition must be filed in a Wisconsin court and is generally used when a person is in immediate danger of harm from another individual. The petitioner must provide evidence to show that the respondent has caused or is likely to cause physical, emotional, or financial harm to the petitioner. There are two types of Wisconsin Petition for Temporary Restraining Order and/or Petition and Motion for Injunction Hearing (Harassment): Temporary Restraining Order (TO) and Injunction Hearing. A TO is a court order that is issued without a hearing and is intended to immediately stop the respondent from engaging in harassing behavior or threats. The TO is typically valid for a period of 14 days and can be extended if necessary. An Injunction Hearing is a full court hearing where the petitioner must prove to the judge that the respondent has caused or is likely to cause harm to the petitioner. If the judge finds that the petitioner has proven their case, the respondent will be ordered to refrain from certain behaviors and may be subject to other court-ordered conditions.
