Wisconsin Judgment Deferred Under Sec. 961.47 is a form of criminal sentence alternative for certain non-violent offenders. It allows a person to be placed under the supervision of the court for a period of time, instead of serving a prison sentence. It is available to offenders who have been charged with certain misdemeanors and felonies. The offender must meet all the eligibility requirements set forth by the court, and must agree to fulfill the terms and conditions of the deferment. The three types of Wisconsin Judgment Deferred Under Sec. 961.47 are: 1) Judgment Deferred Extension, 2) Judgment Deferred Dismissal, and 3) Judgment Deferred with Penalty. With a Judgment Deferred Extension, the court may extend the deferment period to allow for additional time to complete the terms and conditions. With a Judgment Deferred Dismissal, the court may dismiss the case at the end of the deferment period if the offender has fulfilled all the requirements. With a Judgment Deferred with Penalty, the court may impose a fine or other penalty upon the offender if they fail to comply with the terms and conditions of the deferment.
