A Wisconsin Order to Return Firearms under 968.20(1 m), Wis. Stats. (Criminal) is a legal document issued by a Wisconsin court to order the return of firearms that are in the possession of an individual who has been determined to pose a risk of harm to themselves or others. The order is issued under Wisconsin Statute 968.20(1 m) and is commonly referred to as a WOT RETRO”. There are two typesWorksTRFs: an Emergency Order and a Final Order. An Emergency WOT RF is issued when a court finds that the individual poses an imminent risk of harm to themselves or others. The order must be issued immediately and is valid for 14 days or until a Final WOT RF is issued. The Emergency WOT RF orders the individual to surrender any firearms they possess and prohibits them from purchasing or possessing any firearms for the duration of the order. A Final WOT RF is issued after a full hearing has been held and the court finds that the individual poses a risk of harm to themselves or others. The Final WOT RF orders the individual to surrender any firearms they possess and prohibits them from purchasing or possessing any firearms for the duration of the order, which is typically three years. The Final WOT RF also requires the surrender of any ammunition, licenses, and permits related to the firearms.
