Wisconsin Service by Publication Instructions is a legal procedure to serve legal papers to a person who cannot be located or is evading service. This procedure is used when a person is not able to be served in the traditional manner, such as in-person or by mail. Service by Publication is often used to notify a person of a lawsuit, a divorce, or a foreclosure. There are two different types of Wisconsin Service by Publication Instructions. The first type is a “Standard Publication.” This involves publishing the legal documents in a newspaper that is circulated in the county where the person resides. The legal documents must be published for three consecutive weeks in order for the service to be valid. The second type is an “Alternative Service by Publication.” This involves publishing the legal documents in a newspaper that is circulated in the county where the person resides, as well as sending them to the person’s last known address. The documents must be published for two consecutive weeks and sent to the person’s address for a total of four consecutive weeks for the service to be valid. Both types of Wisconsin Service by Publication Instructions require proof of service that must be filed with the court. This proof can be in the form of a certificate of publication or an affidavit of publication.
