A Wisconsin Order on Statement of Noncompliance with Settlement Agreement is a court order issued by the Wisconsin Circuit Court when a party to a settlement agreement fails to comply with the terms of the agreement. The Order requires the non-complying party to show cause why it should not be found in contempt of court for failing to comply with the agreement. The Order also requires the party to provide an explanation as to why the agreement was not performed and to take corrective action to ensure compliance. There are two types of Wisconsin Order on Statement of Noncompliance with Settlement Agreement: a temporary Order and a final Order. A temporary Order is issued when the court is satisfied that there is sufficient cause to issue an Order and the parties must provide additional information to the court before a final Order can be issued. A final Order is issued when the court determines that the non-complying party has failed to comply with the terms of the agreement and the court orders the party to take corrective action.
