The West Virginia Request for Appointment of Counsel-Servicemembers Civil Relief Act (Default Judgment) is a form used by service members to request the appointment of counsel in a civil action. This form can be used when a service member is a defendant in a civil action and a default judgment has been entered against him or her. The form must be filed with the court prior to the hearing in order for counsel to be appointed. The form must be completed by the requesting service member and must include information such as: the service member's name, current address, branch of service, and the date of the default judgment. The form must also include a statement that the service member is unable to afford counsel and is requesting the appointment of counsel. There are two types of West Virginia Request for Appointment of Counsel-Servicemembers Civil Relief Act (Default Judgment) forms: one for service members on active duty, and one for service members who are no longer on active duty.
