Description

A main characteristic of easements is that they are nonpossessory interests in land, or areas above or below it, which entitle the easement holder to the right to use the land for a specific, limited purpose that is not inconsistent with the general use of the property by the owner. An easement is more than a mere personal privilege; an easement invests the holder with privileges that cannot be deprived by the mere will or wish of the proprietor of the servient estate.
