Adding a name to the deeds Equity transfer is not just about removing a name from the deeds. It also includes adding a name. For example, parents may want to add their children to the deeds of the family home. When someone marries their partner, they may want to add them to the deeds of the property they already owned.

When you add someone to the deed, all or a portion of your ownership is transferred to that person. Once it's done, you can't take it back unless the person you've added provides consent to be removed from the deed. He or she can take out a loan on the property, tear it down, or even sell their share of the property.

The person whose name is on the deed has the title to the property. It doesn't matter whether the property was transferred by purchase, inheritance or gift. It's the deed that transfers title. The title deed has the property's legal description, including property or boundary lines.

A deed that conveys an interest in your real estate ownership (adds someone on) has the legal effect of giving that additional person the same bundle of rights to which you are entitled. Once the conveyance happens, it cannot be undone except with that other additional owner's consent.

If your mortgage allows you to add an individual to your title, you can do so by creating and signing a new deed which lists the new co-owner of the property.

If your name is on the deed but not the mortgage, it means that you are an owner of the home, but are not liable for the mortgage loan and the resulting payments. If you default on the payments, however, the lender can still foreclose on the home, despite that only one spouse is listed on the mortgage.

Quitclaim deeds are useful in title-clearing actions or simple transfers between family members or in a divorce. They are not useful in sales or other cases where a more firm guarantee of ownership on the part of the guarantor is needed.
