An affidavit is a written statement of fact voluntarily made by the person under an oath or affirmation before a person authorized by law. An affidavit to be valid has to be executed on Stamp paper or duly stamped otherwise and has to be notarised by a Notary public or commissioner of oaths.

Further, the affidavit must contain the full name, address, occupation and signature of the person (deponent) making such affidavit and the date & place where such affidavit is made. The affidavit must contain facts and circumstances known to a person and must not set out the opinions and beliefs of the deponent.

The person making the affidavit (the deponent) must sign the bottom of each page in the presence of an authorized person, such as a lawyer.

A document in which the affiant makes a statement and swears (or affirms) under penalty and of perjury that the information in the statement is the truth. The affiant must sign the statement in the presence of a notary.
