Bill Delete Sentence For Free

The bill states that any sentencing enhancement that was handed down before January 1, 2020, for a prior separate prison or county jail felony term, is legally invalid. It does exclude enhancements for prior convictions of sexually violent offenses.

In short, the bill is not retroactive, the limitation of the bill as defined by most at this time is that it and only applies to those with open cases at the time of sentencing or re-sentencing without the ability to request a reduction in the sentence.
