State Transfer Tax The tax is applied to instruments that transfer an interest in real property (deed, lease, easement, contract, etc.). The tax is one half of 1 % (0.5%) of the consideration, except for deeds to a first time MARYLAND home buyer, in which case the tax is one fourth of 1 % (0.25%).

Individuals not licensed to practice law in this state may not prepare a deed for anyone else. A Certificate of Preparation attests that the document was prepared by an attorney licesned to practice law in the State of Maryland.

To take someone's name off a deed, a new deed must be prepared to transfer the property from all of the current owners to all of the remaining owners. Similarly, to add someone to a deed a new deed must be prepared to transfer the property from all current owners to all new and current owners.

Maryland law requires all deeds to include the names of the grantor (the seller) and grantee (the buyer), a description of the property, and the interest that you intend to convey. All deeds must be recorded with the Department of Land Records in the county where the property is located.

Recording a deed establishes your ownership interest over another's claim of ownership should there be conflicting claims against the property. Each state has its own recording statute that gives priority to those who record their interest in real property over those who don't.

A Washington, DC, deed must identify by name the current owner (the grantor) transferring the property and the new owner (the grantee) receiving it. Party addresses. A deed should include the new owner's address. DC law does not strictly require the current owner's address, but it is often included.

To change the names on a real estate deed, you will need to file a new deed with the Division of Land Records in the Circuit Court for the county where the property is located. The clerk will record the new deed.
