A handwritten document can be effective as a will or codicil to a will if the court is satisfied that the document is a deliberate or fixed and final expression of the deceased's intention as to the disposal of property upon death.

For example, a non-holographic codicil must be signed in front of two witnesses and have those same individuals sign as well. After that, one of the witnesses must complete an affidavit of execution. After these steps have been taken, the codicil becomes part of your Will and is ready to be used for probate.

In short, no ? a Codicil to a Will does not have to be notarized. However, laws and requirements vary from Province to Province. A Codicil does have to be signed in front of at least two witnesses who are not listed as beneficiaries, guardians, or executors in your Will.

An official can deem a codicil invalid if it is not correctly witnessed, signed, and notarized before being added to the will. A judge can also overrule a codicil. You can have multiple codicils, each dedicated to a different amendment and contradicting codicils.

You can have a lawyer write your codicil for you, or you can make one yourself. However, in most cases it makes more sense just to make a new will. Revoking the old will and making a new one will reduce the possibility of any confusion that could come from having an add-on to your will.

In order for your codicil to be recognized as valid, it may require the signatures of at least two witnesses, neither of whom may have an interest in the terms of the will.
