Minors do not have the legal capacity to enter into a binding contract. However, an agreement made while a person was a minor may be expressly or impliedly ratified once they reach the age of legal majority so that the agreement becomes valid and binding. The age of legal majority is separate from legal age of license.

Section 11 of The Indian Contract Act specifies that every person is competent to contract provided: He should not be a minor i.e and individual who has not attained the age of majority i.e 18 years in normal case and 21 years if a guardian is appointed by the Court.

A basic binding contract must comprise four key elements: offer, acceptance, consideration and intent to create legal relations.

A minor can therefore, enter into a contract. Further, a contract with a minor is voidable. That means they are able to cancel any contract at any time before reaching the age of 18 and for a reasonable period after that time.

The contract age of majority is currently age 18. Contracts entered into by minors under this age are generally voidable at the minor's option. This contract doctrine of capacity is based on the policy of protecting minors from their own poor financial decisions and lack of adultlike judgment.

Voidable means that the contract can be declared invalid if one party chooses to do so. Contracts by minors for items that are not necessities are voidable. This means that minors can disaffirm their contracts provided that the contracts are not for necessities.

Although 18 years is the legal contract age in most states, there are several exceptions?such as the case of emancipation. If the minor hasn't reached the legal contract age but is granted legal status by a court of law, he/she may enter into contracts.
