It forms part of our Constitution ? the highest law in all of Canada ? and is one of our country's greatest accomplishments. Every year on April 17, we celebrate the anniversary of the Charter which was signed in 1982.

Since the Charter is part of the Constitution, it is the most important law we have in Canada. However, the rights and freedoms in the Charter are not absolute. They can be limited to protect other rights or important national values.

The Canadian Charter of Rights and Freedoms (French: Charte canadienne des droits et libertes), often simply referred to as the Charter in Canada, is a bill of rights entrenched in the Constitution of Canada, forming the first part of the Constitution Act, 1982.

Section 33 allows Parliament or the legislature of a province to derogate from certain sections of the Charter, namely section 2 (fundamental freedoms), sections 7 to 14 (legal rights) and section 15 (equality rights).

All Charter rights and freedoms apply to Canadian citizens. There are some restrictions on the rights and freedoms that can be relied upon by people who are not Canadian citizens.

Section 32(1) defines the scope of the Charter's application. The text of section 32(1) provides ?a strong message that the Charter ? is essentially an instrument for checking the powers of government over the individual? : McKinney v. University of Guelph, [1990] 3 S.C.R.
